FIRST: GENERALITIES

This document regulates access to and use of the Arista Joyas website (www.arista.cl), including its online store, through which designer jewelry made with precious and semi-precious stones is sold.

By making a purchase on the website, physical store or any other digital means of Arista Joyas, the user accepts these Terms and Conditions, which will be understood to be incorporated into each purchase contract entered into with the company.

Commercial relations and contracts entered into with Arista Joyas are governed by the laws of the Republic of Chile, especially Law No. 19.496 on the Protection of Consumer Rights , Law No. 21.398 and Measures to encourage the protection of consumer rights and the Interpretative Circular on Good Practices in Electronic Commerce .

Browsing and using this website is free and does not imply any obligation for the user, unless the user expressly states their intention to contract or acquire products offered by Arista Joyas.

When making a purchase through the website or other official sales channels, the user must accept these Terms and Conditions, as well as the policies related to purchases, exchanges, returns and data processing, among others.

FOURTH: PRODUCT CHARACTERISTICS AND CARE

Arista Joyas offers fine jewelry pieces and accessories, including rings, necklaces, earrings and other products made with precious or semi-precious metals and stones.

The handcrafted nature of the jewelry: all Arista Joyas pieces are individually handcrafted using precious metals and natural stones. Due to this manual process, each piece may have slight variations in finish, color, shape, or size, which is part of its unique and authentic character.

Materials used: the jewelry is made primarily of 950 Silver, 925 Silver, 18k Gold and Platinum.

  • 950 Silver contains 95% fine silver and 5% other metals that provide strength and durability.
  • 925 Silver contains 92.5% fine silver and is used especially in chains and components that require greater hardness.
  • 18k Gold is composed of 75% pure gold and 25% alloys that determine its color and properties.

Natural Stones: All stones used are natural, so variations in color, veining, luster, shape, and size may exist between pieces. Likewise, the colors displayed on screen may vary depending on the device settings used to access the website.

The stones are acquired from specialized national and international suppliers carefully selected by Arista Joyas.

Due to the delicate nature of jewelry, it is recommended to handle it with care and follow the care and maintenance instructions provided by the brand. To preserve its condition, avoid impacts, drops, rubbing against hard surfaces, exposure to chemicals or solvents, and wearing the pieces during physical activities or work that could damage or scratch them. Packaging: Each purchase includes official Arista Joyas packaging, which includes a presentation box, suede pouch, and cleaning cloth. Depending on the size of the pieces, up to four pieces of jewelry may be included per box, each in its own protective pouch.

If separate packaging is required for different products, the customer must indicate this at the time of purchase. To reduce environmental impact, we recommend requesting additional packaging only when necessary.


FIFTH: PURCHASE PROCESS

Capacity to purchase: Purchases made through the website may only be made by persons with the legal capacity to contract, in accordance with current Chilean legislation.

Purchase process : To make a purchase on the website, the customer must follow the steps indicated on the platform:

  1. Product selection, stones, metals, size and quantity
  2. Shopping cart review
  3. Read about jewelry care, warranties, and repairs
  4. Entry of personal data and shipping address
  5. Acceptance of the Terms and Conditions
  6. Acceptance of manufacturing times
  7. Payment method selection
  8. Review the complete transaction details, including selected products, prices, shipping costs, and total transaction amount.

Once payment is confirmed, the customer will receive an email with the purchase receipt and relevant information. The manufacturing and shipping time for the product will begin from this point. All communication related to the order, including confirmations, shipping, and any issues that may arise, will be conducted primarily via email.

Prices: All prices published on the website are expressed in Chilean pesos and include applicable taxes in accordance with current legislation. Arista Joyas may modify prices, promotions, or product availability at any time and without prior notice, always respecting confirmed purchases. In case of price differences between other communication channels or external platforms, the price published on the official website will prevail.

Purchases made using credit cards may be subject to fees or interest determined solely by the customer's bank. Arista Joyas will not be responsible for these charges.

Payments and purchase validation: the purchase confirmation will be subject to the validation and approval of the payment by the corresponding platform, with its corresponding proof.

In the event of connection failures, bank rejections, or other issues external to the website that prevent the issuance of a payment receipt, the purchase will be considered incomplete, even if a temporary hold on funds appears in the customer's bank account. The release of funds held by financial institutions depends exclusively on the issuing bank or corresponding institution.

Customer responsibility
It is the customer's responsibility to correctly verify the data entered at the time of purchase, especially for personalized or modified products, such as size, measurements, engravings, designs, or colors.

Subsequent modifications due to errors attributable to the customer may incur additional costs for adjustment, repair, and shipping. To avoid any issues, we recommend carefully reviewing the size guide available on the website before making your purchase.


SIXTH: CUSTOMIZED PRODUCTS, ENGAGEMENT AND WEDDING RINGS

Engagement rings, wedding bands and other custom-made or personalized pieces will be specially crafted according to the specifications provided by each client.

Due to their personalized nature, these types of products are not eligible for return , except in cases provided for by current legislation.

All engagement rings will be crafted using new materials and stones. In the case of diamonds and other precious stones, slight variations in carat weight, proportions, or characteristics may occur, intended to optimize the final quality of the piece within the agreed-upon budget.

In certain cases, Arista Joyas may collaborate in a referential manner in resale processes of pieces, considering the natural wear and tear and the condition of the materials.


SEVENTH: DISPATCH AND DELIVERY

Available shipping and delivery options will be displayed at the time of purchase. Once the order is confirmed, the customer will receive tracking and shipping information via the registered email address.

Delivery times may vary depending on product availability and the type of order placed:

  1. Products in stock:
    - Products without modifications: estimated dispatch within 5 business days.
    - Products with modifications requested by the customer, such as size adjustments: estimated delivery within 10 business days.
  2. Special orders, pre-order, made to order or upon request:
    Products made to order will have an estimated manufacturing and shipping time of up to 30 business days. Shipping and delivery times after shipment will depend exclusively on the corresponding shipping company. Arista Joyas will not be responsible for delays attributable to third-party carriers.

It is the customer's responsibility to provide the correct delivery address and be available to receive the order. Any reshipments, address changes, or additional costs resulting from errors or the recipient's absence will be the customer's responsibility.


EIGHTH: TAX DOCUMENTS

In accordance with current regulations of the Internal Revenue Service (SII), by accepting these Terms and Conditions, the customer authorizes Arista Joyas to send the corresponding electronic tax documents for their purchases, including receipts, to the email address provided during the purchase process. For sales made through Transbank, the receipt corresponds to the Transbank sales receipt.


NINTH: PROTECTION OF PERSONAL DATA

The personal data provided by users will be used solely for purposes related to purchase management, payment validation, dispatch coordination, handling inquiries, and sending information related to Arista Joyas services.

The company undertakes to treat such information confidentially and in accordance with current legislation, not sharing it with third parties without the owner's authorization, except when necessary for the proper execution of the contracted service.

Arista Joyas will never request confidential banking information or personal passwords via email, messages, or social media.

The customer declares that the data provided during the purchase process is truthful, complete and up-to-date.


TENTH: RESPONSIBILITY

Arista Joyas will not be liable for damages or losses arising from the misuse of the website, digital platforms or products by users or third parties.

Furthermore, the company does not guarantee the continuous and uninterrupted availability of the website, as temporary interruptions may occur due to maintenance, technical failures, connectivity problems, or other circumstances beyond its control. In the event of any failures, every effort will be made to restore the website's operation as quickly as possible.

Arista Joyas will also not be responsible for:

  • Content or information published on external sites unrelated to the brand.
  • Delays or inconveniences caused by third-party technology or shipping service providers.
  • Errors resulting from the incorrect use of information or tools available on the site.

In any case, Arista Joyas' maximum liability to the customer, whether contractual or extra-contractual, will be limited to the amount actually paid for the product purchased, without prejudice to the rights that current legislation recognizes for consumers.

Arista Joyas will not be responsible for damages, breakages, structural alterations or losses resulting from repairs, modifications or interventions carried out on jewelry made by third parties.

Furthermore, the reuse or melting down of antique pieces provided by clients will be subject to prior technical evaluation and may only be carried out on pieces made of gold or platinum. Refining the metal will always be recommended.


ELEVENTH: INTELLECTUAL AND INDUSTRIAL PROPERTY

All content available on the Arista Joyas website, including texts, photographs, designs, illustrations, graphics, visual identity, audiovisual pieces, editorial content, product descriptions, educational material, business development and any other element related to the brand and its operation, is the exclusive property of Arista Joyas or its respective owners and is protected by current legislation on intellectual and industrial property in the Republic of Chile.

Reproduction, distribution, modification, publication or use of said contents in whole or in part is prohibited without prior written authorization from Arista Joyas.


TWELFTH: APPLICABLE LEGISLATION

These Terms and Conditions are governed by the laws of the Republic of Chile.

Any dispute relating to the use of the website, purchases made, the interpretation of these Terms and Conditions or the company's policies, will be resolved in accordance with current Chilean legislation and subject to the jurisdiction of the competent courts of Chile.
